By installing, accessing, or using Showel (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our Service.
These Terms apply to all users of the Service, including without limitation users who are administrators, developers, and end users of the Service.
2. Description of Service
Showel is an Atlassian Forge application that provides AI usage analytics for development teams. The Service allows you to:
- Track AI assistant (Cursor AI, etc.) token usage
- View usage analytics and reports within Jira
- Monitor team AI consumption and costs
- Display custom fields showing developer-specific usage
The Service operates entirely on the Atlassian Forge platform and integrates with your Jira Cloud instance.
3. User Requirements
Eligibility
To use the Service, you must:
- Have a valid Jira Cloud instance with administrative access to install apps
- Be at least 18 years of age or the age of majority in your jurisdiction
- Have authority to bind your organization to these Terms
- Comply with all applicable laws and regulations
Account Responsibilities
You are responsible for:
- Maintaining the security of your Jira instance and API credentials
- All activities that occur under your account
- Ensuring your use complies with these Terms
- Notifying us immediately of any unauthorized use of your account
4. Acceptable Use
Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service:
- To track and analyze AI usage within your organization
- In compliance with all applicable laws and regulations
- In accordance with Atlassian's terms of service
Prohibited Use
You agree NOT to:
- Reverse engineer, decompile, or disassemble the Service
- Attempt to gain unauthorized access to any portion of the Service
- Use the Service to violate any applicable laws or regulations
- Interfere with or disrupt the Service or servers
- Use the Service to harm, harass, or violate the privacy of others
- Transmit any viruses, malware, or malicious code
- Circumvent any security features or rate limits
- Use the Service for competitive analysis or to build a competing product
5. API and Third-Party Services
API Credentials
You are responsible for:
- Obtaining and maintaining valid API credentials from third-party services (e.g., Cursor AI)
- Ensuring you have authorization to use these credentials
- Complying with the terms of service of third-party AI platforms
- Any costs associated with API usage from third-party services
Third-Party Terms
Your use of the Service is also subject to:
- Atlassian's Terms of Service and Forge Platform terms
- Cursor AI and other AI platform terms of service
- Any other applicable third-party terms
6. Intellectual Property Rights
Our Rights
The Service and its original content, features, and functionality are owned by Showel and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Your Rights
You retain all rights to your data. By using the Service, you grant us a limited license to access and process your data solely to provide the Service to you.
Feedback
Any feedback, comments, or suggestions you provide regarding the Service may be used by us without any obligation to you.
7. Fees and Payment
Pricing
Certain features of the Service may be provided for a fee. You agree to pay all applicable fees as described at the time of purchase. All fees are non-refundable unless otherwise stated.
Payment Terms
- Fees are charged in advance on a subscription basis
- Subscriptions automatically renew unless cancelled
- You authorize us to charge your payment method for renewal fees
- Price changes will be notified in advance with option to cancel
Third-Party Costs
You are responsible for any fees charged by third-party services (AI platforms, Atlassian, etc.) in connection with your use of the Service.
8. Data and Privacy
Data Processing
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to such processing.
Data Architecture
Important: We do not operate our own servers. All data is stored within Atlassian's Forge platform infrastructure and subject to Atlassian's security and privacy standards.
Your Data Rights
- You retain ownership of your data
- You can export your data at any time
- You can delete your data by uninstalling the app
- We do not sell or share your data with third parties
9. Service Availability and Support
Availability
We strive to provide reliable Service but do not guarantee:
- Uninterrupted or error-free operation
- That defects will be corrected immediately
- That the Service will meet your specific requirements
- Availability during maintenance windows
Maintenance
We may perform scheduled or emergency maintenance that temporarily interrupts the Service. We will provide advance notice when possible.
Support
Support is provided via email and documentation. Response times vary based on your subscription level.
10. Termination
By You
You may terminate your use of the Service at any time by uninstalling the application from your Jira instance.
By Us
We may terminate or suspend your access immediately, without prior notice, if you:
- Breach these Terms
- Engage in prohibited activities
- Fail to pay applicable fees
- Violate applicable laws or regulations
Effect of Termination
Upon termination:
- Your right to use the Service ceases immediately
- Data stored by the application will be deleted per Atlassian Forge policies
- Provisions that should survive termination remain in effect
11. Disclaimers
"As Is" Basis
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding accuracy, reliability, or completeness of data
- Warranties that the Service will be uninterrupted or error-free
Third-Party Services
We are not responsible for:
- Availability or performance of third-party services (Atlassian, Cursor AI, etc.)
- Accuracy of data provided by third-party APIs
- Actions or omissions of third-party service providers
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Showel and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of applicable laws or regulations
14. Governing Law and Dispute Resolution
